By accessing and using Moolyka ("Platform"), operated by Tideflash ("Company"), you agree to be bound by these Terms of Service. If you disagree with any part, you may not access our services.
Moolyka is an impact-to-commerce platform connecting donors, beneficiaries, and suppliers. Our mission is to illuminate African initiatives through transparent, item-specific donations.
2. User Accounts
2.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
2.2 Account Types
We offer three types of accounts:
- Donor Accounts: For individuals/organizations making donations
- Beneficiary Accounts: For verified initiatives seeking support
- Supplier Accounts: For businesses listing products for donation
2.3 Account Features
Registered users can:
- View complete donation history (payments & orders)
- Track delivery status of donated items
- Download receipts and impact reports
- Save favorite projects and suppliers
- Update payment preferences
2.4 Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms
- Provide false information
- Engage in fraudulent activities
- Compromise platform security
3. Donations & Payments
3.1 Payment Methods
We accept:
- M-Pesa (Mobile Money)
- Credit/Debit Cards (Visa, Mastercard)
- Cryptocurrency (Ethereum, Binance Smart Chain, Solana, Celo, Polygon, OKTC)
- Bank Transfers
3.2 Donation Process
When you donate:
- You select specific items from verified suppliers
- Payment is processed through SMPLY Pay (Tideflash's payment system)
- Crypto donations are automatically converted to fiat
- Funds are held in escrow until delivery confirmation
- Suppliers receive payment upon verified delivery
3.3 Fees & Charges
- Platform Fee: 5% of donation amount
- Payment Processing: Varies by method (2-3%)
- Crypto Conversion: Market rate + 0.5% fee
Fees are clearly displayed before checkout. You may choose to cover additional fees.
3.4 Refunds & Cancellations
Donations are generally non-refundable except:
- If project fails verification within 7 days
- Technical error causing duplicate charges
- Fraudulent transactions (subject to investigation)
4. Projects & Listings
4.1 Project Verification
All projects undergo:
- Documentation review
- Site verification where applicable
- Beneficiary needs assessment
- Ongoing monitoring and reporting
4.2 Supplier Requirements
Businesses listing products must:
- Be legally registered in Africa
- Provide quality products/services
- Maintain fair pricing
- Honor delivery commitments
- Use SMPLY Store ERP for order management
5. Intellectual Property
All content on Moolyka (logos, text, graphics, software) is owned by Tideflash or licensed to us. Users retain rights to their uploaded content but grant us license to display and distribute it in connection with our services.
6. User Conduct
You agree not to:
- Use the platform for illegal purposes
- Impersonate any person or entity
- Upload harmful content (malware, viruses)
- Harass or threaten other users
- Attempt to circumvent security measures
- Engage in fraudulent fundraising
7. Termination
We may terminate or suspend your account immediately without notice for conduct violating these Terms. Upon termination, your right to use the Platform ceases immediately.
8. Disclaimer
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- Accuracy of project information
- Success of funded initiatives
- Product quality from suppliers
We are not responsible for disputes between donors, beneficiaries, and suppliers.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIDEFLASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
10. Governing Law
These Terms shall be governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use after changes constitutes acceptance.
